Consumer Data Right Policy

About this policy

‘We’, ‘us’ and ‘our’ refer to Nano Platform Pty Ltd (ACN 636 165 501) (‘Nano’), a technology provider to lenders and other businesses.

This policy explains your rights under the Competition and Consumer Act 2010 (Cth) and the Competition and Consumer (Consumer Data Right) Rules 2020 (CDR Rules).

It sets out what your CDR data is, how you can access and correct it, and how to make a complaint if necessary.

What is the Consumer Data Right (CDR)?

The Consumer Data Right (CDR) is a right created under this legislation. It gives consumers the right to access data relating specifically to them (their ‘CDR data’), to have that data shared with accredited third parties, and to have it corrected where necessary.

As an accredited data recipient, we may also ask for your consent to collect your CDR data from a third party, so that we and the Lenders we support can gain a better understanding of your financial position by comparing it with data held by other financial providers.

The CDR regime makes it easier for you to compare products for better value and helps with your financial management.

Access to your consumer data

To collect your CDR data on your behalf, we require your consent. You give this consent by authorising your data holder (for example, your bank) to share your CDR data with us. Once we have received your CDR data, we will only disclose it to the relevant Lender with your separate consent.

The CDR data we collect includes information relating to:

  • Income
  • Expenses
  • Liabilities
  • Repayments
  • Account balances and account name

Sharing your CDR data with Nano

We are an accredited data recipient. We collect CDR data on behalf of Lenders, who are accredited organisations, and share your CDR data with those Lenders and other financial institutions only when you allow us to do so. We do not charge a fee for this service.

As an accredited data recipient, we may also ask for your consent to share CDR data that other financial providers hold about you with us. You are not obliged to give this consent, but doing so gives us a better view of your overall financial position, helping us provide a tailored experience suited to your needs and requirements.

Your consent will remain valid for 12 months. We may occasionally ask you to renew it.

If you want us to immediately stop holding your CDR data, please contact the Lender. If you have asked us to stop, or your consent has expired, we will delete the data we hold, unless we are legally required to keep it.

Can I correct errors in my consumer data?

If any CDR data we hold about you is inaccurate, out of date or misleading, you can ask us to correct it during the application process by contacting us or the applicable Lender. Once your loan application has been completed, you will need to contact the applicable Lender to have it corrected.

If we receive a request to correct your data, we will, within 10 business days, let you know in writing whether we corrected your CDR data or notified the Lender to do so. If we decide a correction is unnecessary, we will provide our reasons. If we cannot correct the CDR data ourselves, we will explain why and direct you to the applicable Lender. If your request isn’t resolved to your satisfaction, you can lodge a complaint with us.

Complaints

If you are dissatisfied with the handling of your CDR data, you can contact us at cdr@nanoplatform.com with details of your complaint. We will acknowledge your complaint within seven days, aim to resolve it as quickly as possible, and provide you with a decision within 30 days.

If you are dissatisfied with our complaints officer’s response, you can make a complaint to the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or on 1300 363 992.
